A jury should not be instructed to determine if laws are or aren't broken, as a the intent of a jury is to decide if the common person would deem an accused offense as right or wrong.
Laws are not always constructed to take every situation into consideration, which is why we're allowed to have our peers review individual cases.
As some times laws are written incorrectly, or purely for political reasons.
