Opinion Prosecuting attorneys and district attorneys who file charges that they know will not hold up in court, so that a criminal will walk and not be charged with a lesser charge, are guilty of obstructing justice, and place the population in harms way. This seems to happen when police shootings are tried as first or second degree murder, where the high level of proof and intent will likely fail, and manslaughter was more appropriate; when the murder charge doesn't stick, manslaughter charges are avoided.
